Regulation on Maternity Leave in Beijing

  1. Regulations on Maternity Leave for Employees in Beijing

    According to Special Regulations on Labor Protection for Female Employees and the Notice on Adjusting the Relevant Policies of Maternity Insurance for Employees in this Municipality issued by the Beijing Municipal Bureau of Human Resources and Social Security, female employees shall enjoy maternity leave based on below detailed provisions:

    (1)
    Female employees enjoy 98 days’ maternity leave for eutocia, in which 15 days’ leave can be taken before the childbirth; an additional 15 days’ leave could be enjoyed for dystocia; for multiple birth, an extra 15 days’ leave could be enjoyed for each additional birth.
    (2)
    For termination of pregnancy of less than 16 weeks (inclusive),15 days’ maternity leave shall be given; for termination of pregnancy of more than 16 weeks, 42 days’ maternity leave shall be given.
    (3)
    The employer shall arrange 1 hour of breastfeeding time for female employees during lactation within the working hours of each day; for those giving birth to multiple babies, an extra hour of breastfeeding time will be added each day for each additional baby.

  2. Regulations of Beijing Province on Population and Family Planning

    According to Regulations of Beijing Municipality on Population and Family Planning, for couples who give birth to children according to regulations, in addition to enjoying the maternity leave stipulated by the state, the female employees could enjoy an extended maternity leave of 60 days, and the male employees could enjoy 15 days of paternity leave. With the consent of the employers, the female employees may enjoy another 1 to 3 months of leave. Both the husband and wife may adjust the distribution of extended maternity leave with the consent of their employers. If the wife voluntarily reduces the extended maternity leave, the paternity leave enjoyed by the husband may be increased by the corresponding number of days.

    Couples who give birth to children according to regulations shall enjoy 5 working days of parental leave each year respectively before their children reach 3 years’ old; the aforesaid “each year” is calculated according to the children's full age. Both the husband and wife may adjust the distribution of parental leave with the consent of their employers. The total parental leave enjoyed by the husband and wife shall not exceed 10 working days.

  3. Other related regulation

    According to the Law of People’s Republic of China on the Protection of Rights and Interests of Women, employers should not dismiss or cut salaries of female employees due to marriage, pregnancy, maternity leave, breast-feeding. However, this rule is not applicable when female employees resign voluntarily.
