Q:
If an insured person in Taiwan passes away during the valid insurance period and has met the conditions for claiming old-age benefits, can they choose to claim the old-age benefits in a lump sum?
A:
If an insured person passes away during the valid insurance period, they are entitled to claim death benefits as stipulated. However, if the insured person has already met the conditions for claiming old-age benefits in terms of required years of service or age at the time of death, the designated beneficiary may choose to forgo the death benefits in favor of claiming a more advantageous old-age benefit in a lump sum, in accordance with the regulations for claiming elderly benefits.

Q:
In the qualifications for claiming a testamentary annuity in Taiwan, what does “marriage relationship lasting over a year” mean?
A:
The spouse eligible for claiming a survivor’s annuity must have had a marriage relationship with the insured person that lasted more than one year. The calculation of this period is done by continuously counting backwards for one year from the date of the insured person’s death.

Q:
Is the application and disbursement of survivor’s annuity in Taiwan the same as other annuity?
A:
No, it’s different. Labor insurance disability and old-age pensions are disbursed monthly starting from the month of application. However, beneficiaries who meet the qualifications for a survivor’s annuity can claim payments retroactively for up to five years from the date they apply for the benefit.

Q:
Does Taiwan’s survivor’s annuity also last for life?
A: Not necessarily. Different types of survivors have different eligibility criteria for claiming the annuity. An annuity is granted only when the eligibility meets the criteria. If a survivor loses their eligibility (for reasons such as detention or imprisonment, disappearance, the spouse remarrying, or children reaching adulthood and not being in school), the Labor Insurance Bureau will cease the disbursement of the survivor’s annuity starting from the month following the occurrence of such an event.

Q:
When there are more than two applicants for the funeral subsidy or survivor’s annuity (subsidy) in Taiwan, how should it be claimed? If an agreement cannot be reached, how will the Labor Insurance Bureau distribute the payment?
A: When there are more than two applicants for a funeral subsidy or survivor’s annuity (subsidy), they should apply together. If not applied for jointly, or if someone else applies before the Labor Insurance Bureau’s approval, the bureau will notify the applicants in writing to reach an agreement within 30 days. If an agreement cannot be reached, the total amount of the funeral subsidy or survivor’s annuity (subsidy) will be distributed equally among the applicants.
