What is notarization service?
A:
Notarization service is the process where a Notary Public signs his/her signature and affixes his/her individual seal on a document after authenticating documents or witnessing signatures. Authenticated documents received from the notary public are known as “notarized documents”.

Q:
Who can be a Notary Public in Hong Kong?
A:
A Notary Public is an experienced solicitor, registered in the Register of Notaries Public kept by the High Court of Hong Kong who can notarize a document, either authenticating a signature, certifying or witnessing a person’s identity and certifying a legal document as genuine or an original.

Q:
What are the purposes of notarization and what documents usually need to be notarized of a Hong Kong company?
A:
Notarized documents are usually requested by the oversea receiving parties, such as banks or government authorities, to ensure the trueness of documents. The notarized documents may be used for the sale or purchase of land, trading, immigration, company registration or bank account opening.

Common notarized documents of a Hong Kong company include:
  1. Business Registration Certificate;
  2. Certificate of Incorporation;
  3. Articles of Association ;
  4. Annual Return;
  5. Resolution, Agreement and/or business contract; and
  6. Passport copy of director, shareholder or authorized signer.

Depend on the jurisdiction where the receiving party located, the notarized document may also be requested for further apostilling by High Court or certifying by Embassy.

For the documents using in China, it required to be legalized by a solicitor in Hong Kong who qualified as China-Appointed Attesting Officers. The service usually calls as “China Notarization” but it is not related to Notary Public.

A: Normally it takes around two to three working days (excluding delivery) for the Notarization process.
