From time to time, we have received similar enquiries from foreign clients working in Beijing, “hi, my employer is changed, do I need to cancel my current work permit and apply for a new one under the name of the new employer? My work permit is going to expire, what should I do?” This article listed out the most frequently asked questions in relation to renewal, change, cancellation and reissuance of work permit in Beijing for clients’ reference.  

Q: My work permit is going to expire, what should I do?
A: You need to apply for renewal of the work permit if you will continue to work for the same employer. As it takes time to get the renewal application granted, it is advised to make preparation for the renewal within 90 days before the date of expiry.  

Q:
What do I need to prepare for renewal of working visa?
A:
The applicant needs to prepare the following documents and forms:
  • Employment contract
  • Passport and valid work-type residence permit
  • Passport-size colourful photo in white background
  • The applicant’s work permit
  • Valid accommodation registration form
  • Health check report (issued within the latest six months)
  • Chinese translation of all documents in foreign languages
  • Other documents required

Q:
When do I need to apply for change of my working visa?
A:
You will need to apply for change of work permit when there is change in the applicant’s name, passport number, position, category of the work permit, etc within ten working days after the change incurs. You will also need to apply for change of resident permit when there is change in the applicant’s name, gender, birth date, type of residence, residence period, issuance date and address, passport number, etc within ten days after the change incurs.

Please pay attention: in case there is post change from one professional field to another, you will need to cancel the current work permit and re-apply a new one. For instance, if your post is changed from sales director to biotech engineer, you will need to apply for a new work permit by providing relevant working experience proofing documents as a biotech engineer.  

Q:
My work permit is lost; how can I get a new one?
A:
You can apply for re-issuance of the work permit. Before that, you will need to publish a missing statement in designated newspaper on the date of loss or when you find the permit is missing.

Q:
When does the work permit need to be cancelled?
A:
The work permit will be automatically revoked if no renewal is made before the date of expiry. The employer company shall apply for cancellation of the work permit and report to the entry and exit administration within ten days after the following situations occur:
  • foreign staff changes his/her working city
  • foreign staff terminates the employment contract in advance
  • foreign staff resigns
  • foreign staff cannot be contacted by the company
  • foreign staff violates the immigration regulations
  • foreign staff lose capacity
  • foreign staff is missing or dead

Q:
How long does it take for working permit renewal, change, cancellation and reissuance?
A:
It takes ten working days to renew, change or cancel the work permit and fifteen working days for reissuance of work permit.

Q:
How long does it take for resident permit renewal?
A:
Seven working days.

Q:
Is physical presence of the expatriate required for renewal, change, cancellation and reissuance of work permit?
A:
No.

Q:
Is physical presence of the expatriate required for renewal of resident permit?
A: Yes.

Q:
During the application of resident permit, my passport will be kept by the immigration department, how can I legally reside in China without my passport on hand?
A:
During the period when the applicant’s passport is under the legal custody by the exit-entry authority for the issuance of resident permit, the applicant may reside legally within the territory of China with the receipt notice of the application
