The European Patent Office announces fee increase from 1 April 2023

The European Patent Office (“EPO”) has announced an increasement of some official fees that will apply on 1 April 2023, just a year after its last fee increase in April 2022. On average, the official fees will increase by around 4-6%. In view of the EPO’s official fee increases, it is advisable to pay an official fee before 1 April 2023, before the increases take effect. It is advisable to file a new European regional patent application, or make early payments on existing patent application before 1 April 2023 to avoid the fee increase. As an example, maintenance or renewal fees can be paid up to 3 months in advance of their due date, while the first fee (3rd year) can be paid up to 6 months in advance. Filing a divisional application before 1 April 2023 is also recommended for cost saving, as this is requesting for an examination ahead of the due date.
