Do all trademark offices classify the goods and services with the same classification? |
A: |
Around 150 trademark offices in the world adopt Nice Classification to classify the goods and services. It is an international classification system. There are 34 classes of goods and 11 classes of services. A new edition is published every five years and a new version of each edition is published annually since 2013. Most countries adopt the current version and edition. However,several countries are still using the old version and edition. |

It depends on the trademark offices. Most countries do not allow filing the heading. |

Some trademark offices limit the number of goods/services in each class. The applicant shall pay an extra fee for each additional item. If finance allows,you may file all goods/services in that class. However,even the office has no limitation on the number of goods/services,it is advisable to file the goods/services which are really related to your business only,around 20 items in each class. |

How could I obtain wider protection if the office does not accept filing the heading of the class? |

It is advisable to select items that have broader meaning. For example: select “Fruits” instead of “Apple”,“Orange” or “Banana”;select “Cosmetics” instead of “Eyebrow pencils”,“Mascara” or “Lipsticks”;select “Clothing” instead of “Topcoats”,“Tee-shirts” and “Shirts”,etc. However,if some particular goods/services that you really want to indicate out,you may indicate them and also select some broader items. Please confirm with your agent whether the items are likely to be accepted by the trademark office when you are selecting the items. |
