What application documents are required for an application under Admission Scheme for Mainland Talents and Professionals (“ASMTP”)? |

The employing company should submit the duly completed application form ID990A and ID990B together with all supporting documents to the Hong Kong Immigration Department (“Immigration Department”). Please contact us for a detailed application supporting document checklist if required. |

How long does it take to process an application under the ASMTP? |

The application generally takes 4 to 6 weeks from the date of submission to the Hong Kong Immigration Department. Processing times can be varied according to the background of the applicant, sponsoring company and submitted documentations. The Immigration Department will not be able to start processing the application unless all the required documents and information have been submitted. |

Can a company registered in China apply a Hong Kong visa application under ASMTP for its staffs? |

No. Applications under the ASMTP must be submitted by the employer who is a registered company in Hong Kong. |

Can a Mainland resident take up employment in Hong Kong by holding an “Exit-entry Permit for Travelling to and from Hong Kong and Macao” and “Business Visit Endorsement”? |
A: |
No. Mainland resident who holding an “Exit-entry Permit for Travelling to and from Hong Kong and Macao” and “Business Visit Endorsement” may be granted permission to land in Hong Kong as a “visitor”. As a visitor, he/she is not allowed to take up any employment whether paid or unpaid in Hong Kong. Mainland resident who wishes to come to the Hong Kong and take up employment should apply the visa under the ASMTP. |

Is there are any requirements for the applicant to stay in Hong Kong a minimum number of days in Hong Kong after admitted under ASMTP? |

There is no specified requirements on the number of days for staying in Hong Kong after admitted under ASMTP. |

Can my family members come with me to Hong Kong after admitted for employment under ASMTP? |
A: |
You can submit the application for dependent visa(s) along with your ASMTP applications or after you granted the employment visa for unmarried dependent children under the age of 18 and/or spouse to Hong Kong. You (the applicant) will be the sponsor of accompanying dependents to Hong Kong. The length of stay of such dependents will normally be linked with your (the sponsor’s) Visa. |

If the person who admitted under ASMTP and continuing stays in Hong Kong for 7 years or above, can he/she apply for Right of Abode in Hong Kong? |

Under the Immigration Ordinance, the person who admitted under ASMTP and ordinarily resided in Hong Kong for a continuous period of not less than seven years, he/she may apply for Right of Abode in Hong Kong. However, The Immigration Department will assess the applicant's eligibility for right of abode in accordance with the relevant provisions of the laws regarding right of abode on a case-by-case basis. |

Once the applicant gets an ASMTP Visa, is he/she free to work in Hong Kong for any employment? |

No. An employment visa is specific to that employer as stated in the visa application. He/She must apply for a change of sponsorship by filing an extension of stay before taking up another employment in Hong Kong. It is illegal to work for another company before granted the approval. |
