Argentina INPI 2026: Simplified Assignment and Name Change Procedures

The National Institute of Industrial Property of Argentina (INPI) has issued Resolution No. 162/2026. This resolution updates the application requirements and examination standards for both the assignment of industrial property rights and changes of legal name.

Key amendments of the Resolution:

  1. Elimination of Apostille and Consular Legalization

    Exemption from Legalization: Assignment and change of name documents executed abroad no longer require an Apostille or consular legalization.
    (2)
    Scope of Application: This simplified policy applies strictly to assignment and change of name procedures. Document requirements for other intellectual property proceedings remain unchanged.
    (3)
    Translation Requirements: All supporting documents in languages other than Spanish must still be translated by a local sworn translator and certified.
    • Changes of Name: Official supporting documents in a foreign language must be translated and certified by a registered translator.
    • Assignments of Rights: Translation is not required if the document is in Spanish or bilingual. However, the notarization block must be in Spanish; otherwise, the notarization itself must be translated and certified by a registered translator.
    (4)
    POA Exception: This new policy does not apply to Powers of Attorney (POAs). A POA must still be notarized and apostilled. New owners must still provide a notarization and apostilled POA when processing an assignment or change of name.

  2. Legal Effect of Documents as Affidavits

    (1)
    Duty of Honesty: All submitted information and documents are deemed to have the legal effect of an affidavit. Parties are strictly responsible for their authenticity (though the regulation does not explicitly state the specific penalties for parties or agents in case of non-compliance).
    (2)
    POA Declaration System: Pursuant to the latest amendments to the Argentine Civil and Commercial Code, physically attaching a notarized and legalized Power of Attorney (POA) at the time of filing is no longer mandatory. Instead, a declaration confirming its existence and authenticity is sufficient.
    (3)
    Significant Risk: If a declared POA is subsequently found to be non-existent or fails to meet legal formatting requirements, all proceedings executed by the agent will be rendered completely void and cannot be remedied.

  3. Relaxing Restrictions on Registration Applicants

    Both Parties Eligible: Either the assignor or the assignee may now apply for an assignment application.

  4. Effective Date Against Third Parties

    Retroactive to the Application Date: The resolution clarifies the "declaratory nature" of the recordal. It rules that the legal effect against third parties starts from the date the application is submitted to the Trademark Office (under the previous system, it started from the date the Trademark Office officially issued its formal approval).

  5. New Correction and Amendment Procedures

    Notification Prior to Rejection: A new correction mechanism will be introduced for observations issued by the Trademark Office. This allows interested parties to correct or regularize their documents before an official rejection is issued.
