China Relaxes Restriction on Foreign Invested Travel Agency

China Relaxes Restriction on Foreign Invested Travel Agency

Recently, the State Council of the PRC released a circular on the approval of temporary adjustment of laws and regulation in four cities, which includes the adjustment of the Travel Agency Regulations.

According to the Travel Agency Regulations, which were promulgated in 2009, foreign-invested travel agencies are not permitted to organize travel for mainland Chinese residents outside of China, or to Hong Kong Special Administrative Region, Macao Special Administrative Region, or Taiwan unless otherwise stipulated by a decision of the State Council, a free trade agreement signed by China, or an arrangement between the mainland and Hong Kong and Macao to establish closer economic and trade relations.

The above restriction set by the Travel Agency Regulations will be adjusted in Shanghai and Chongqing until 8 April 2024, which allows qualified foreign invested travel agencies established in Shanghai and Chongqing to provide travel services to mainland Chinese residents outside of China, including Hong Kong Special Administrative Region and Macao Special Administrative Region, but excluding Taiwan.
